Overview of the Trial
The criminal proceedings against Linda Sun, a former aide to two New York governors, center on allegations of illegal foreign agent activities. Prosecutors assert that these actions are part of China’s extensive operations aimed at swaying U.S. government policies and public opinion in favor of the Chinese Communist Party.
Initially focused on illegal influence, the case has broadened over the past year to include corruption charges against both Ms. Sun and her husband, Chris Hu.
Ms. Sun served under former Democratic Governor Andrew Cuomo and current Governor Kathy Hochul. She faces accusations of misusing her official role to advance China’s interests by obstructing officials from Taiwan and minimizing discussions about China’s human rights violations against Uyghur minorities.
Both Ms. Sun and Mr. Hu have pleaded not guilty to over 30 federal charges, which encompass operating as an illegal Chinese agent, visa fraud, wire fraud, money laundering, bribery, conspiracy to defraud the United States, and tax evasion.
The trial is currently in its fourth week at a federal court in Brooklyn and is part of a broader initiative by the Justice Department to combat CCP influence operations and transnational repression.
Amanda Shami, one of the prosecutors, described Ms. Sun’s actions as a betrayal of New York’s trust. She emphasized that Ms. Sun was willing to sell her loyalty for financial gain from the Chinese government.
“Her loyalty was for sale,” Shami stated during her opening remarks.
The prosecution presented evidence including documents allegedly forged by Ms. Sun that were signed by governors. A notable charge in a recent indictment claims that she directed state contracts towards Chinese firms for personal protective equipment during the COVID-19 pandemic.
The alleged payoffs from China included significant financial gains for both Ms. Sun and Mr. Hu.
This case is considered one of the FBI’s most crucial counterintelligence investigations aimed at unveiling Beijing’s widespread influence tactics within the United States.
