The Pentagon’s Warning
The Pentagon has indicated that it may recall Senator Mark Kelly, a former Navy pilot, to active duty. This action could lead to court-martial proceedings due to serious allegations of misconduct currently under investigation.
Senator Kelly, a Democrat from Arizona, participated in a video alongside five other Democratic lawmakers urging U.S. troops to disregard any “illegal” orders from President Trump.
In response to the video, Defense Secretary Pete Hegseth criticized it as “despicable, reckless, and false,” asserting that it undermines military discipline.
Having retired as a captain in October 2021 after 25 years of service in the Navy and NASA, Mr. Kelly stated that the video merely advised service members not to follow unlawful orders. The Defense Department did not specify the exact nature of the alleged misconduct but referenced 18 U.S. Code Section 2387 regarding actions that promote insubordination within the military.
Mr. Hegseth emphasized that encouraging troops to ignore their commanders’ orders jeopardizes military order and discipline. He noted that such statements could bring discredit upon the armed forces.
Senator Kelly expressed his awareness of potential recall through social media posts by Mr. Hegseth and asserted that attempts to intimidate him would not succeed. He emphasized his commitment to holding the administration accountable.
The other lawmakers featured in the video are also veterans or former CIA personnel, which has drawn significant backlash from the White House. President Trump condemned their actions as traitorous and accused them of instructing troops not to obey presidential orders.
As a retired Navy member, Mr. Kelly remains subject to military law under the Uniform Code of Military Justice (UCMJ). The Defense Department is reviewing his statements made while using his rank and affiliation with the military.
Democrats and some Republicans have raised questions about the legality of U.S. military operations targeting suspected drug trafficking boats in Caribbean waters and deploying National Guard troops domestically.
A Texas Tech law professor highlighted concerns regarding how political discourse affects perceptions of military justice, referencing past comments made by President Trump about court-martials.
