1. What is the Laken Riley Act, and why was it established?

The Laken Riley Act represents the first legislation signed by President Trump during his second term. It is named after a 22-year-old nursing student from Georgia who was tragically murdered by a Venezuelan illegal immigrant in February 2024. This law mandates that the Department of Homeland Security detain illegal immigrants arrested for crimes such as theft or assaulting law enforcement officers, ensuring they are held for processing by U.S. Immigration and Customs Enforcement. Additionally, it empowers states to sue the federal government if federal immigration laws are violated in ways that jeopardize U.S. citizens.

Since its enactment, over 17,500 illegal immigrants have been apprehended for various offenses under the Laken Riley Act. DHS Secretary Kristi Noem revealed these statistics following Operation Angel’s Honor, a two-week nationwide initiative aimed at targeting individuals who committed crimes outlined in the act, resulting in ICE arresting 1,030 criminal illegal aliens.

Laken Riley was a 22-year-old nursing student from Georgia who lost her life in February 2024 at the hands of a Venezuelan illegal immigrant. The Department of Homeland Security reported that this individual had been previously arrested and released prior to Riley’s murder and was affiliated with Tren de Aragua, a terrorist criminal gang designated as a Foreign Terrorist Organization by the State Department in February.

The operation has led to the arrest of individuals convicted of various serious offenses, including one Cuban national with 17 counts of larceny and another individual from India convicted on four counts of sexual assault. The focus has been on apprehending illegal immigrants involved in crimes specified by the Laken Riley Act, such as theft and assaults on law enforcement personnel.

The American Civil Liberties Union has voiced strong opposition to this legislation, labeling it as perpetuating a “false, xenophobic narrative about immigrants.” They describe the bill as “a wolf in sheep’s clothing,” arguing that it exploits Riley’s tragic death while expanding detention practices for those accused of non-violent offenses without enhancing public safety and fostering discriminatory overdetention.
