Gang Membership Allegations
Kilmar Abrego Garcia’s alleged affiliation with MS-13 is central to his involvement in a significant migrant smuggling operation, according to the Justice Department. They claim this connection intimidated migrants into paying for their transport.
Prosecutors informed a federal judge of their intention to introduce evidence regarding Mr. Abrego Garcia’s gang ties during the trial, aiming to substantiate the smuggling charges against him.
Additionally, they plan to call a witness who claims that Mr. Abrego Garcia sent her “pornographic messages and videos” when he was 25 years old and she was just 15.
An illegal immigrant, Mr. Abrego Garcia has been embroiled in a lengthy deportation battle this year. He faces accusations of migrant smuggling linked to a traffic stop in Tennessee in 2022, where authorities allege he was found transporting undocumented immigrants.
Although he wasn’t charged at that time, the Trump administration revisited his case after federal courts pressured them to halt his deportation from El Salvador, resulting in an indictment.
The prosecution asserts that Mr. Abrego Garcia was utilized by the smuggling ring to extract payments from reluctant passengers believed to be gang members. Jason Harley, the government’s trial attorney, stated that Mr. Abrego Garcia’s gang affiliation made him an ideal candidate for this role due to previous difficulties the organization faced in collecting fees from gang members.
Mr. Abrego Garcia has pleaded not guilty and denies being part of MS-13, despite conflicting findings from an immigration judge in 2019 who ruled he was affiliated with the gang based on local law enforcement reports.
A U.S. district judge has dismissed these allegations as lacking substantial evidence. However, prosecutors claim individuals involved in the smuggling operation are ready to testify about Mr. Abrego Garcia’s gang connections.
The prosecution also intends to present evidence regarding Mr. Abrego Garcia’s alleged mistreatment of female migrants within the smuggling network, which they argue impacted operations and caused discord among crew members.
The attorney mentioned plans to introduce cell phone records indicating numerous trips made by Mr. Abrego Garcia between Maryland and Texas during 2022 and 2023, including one trip that led to his indictment.
This phone number is reportedly linked back to him through domestic violence protection orders filed by his wife against him in previous years.
Mr. Harley acknowledged that some evidence might be prejudicial but deemed it necessary for establishing ownership of the phone used during these activities.
The government reiterated its claims regarding Mr. Abrego Garcia exchanging “pornographic” messages with an underage girl and plans to call her as a witness during the trial.
The prosecution does not initially intend to present these messages but may do so later depending on how defense attorneys approach her testimony.
Despite an immigration judge’s order against deporting him specifically back to El Salvador, Mr. Abrego Garcia was sent there in March as part of ongoing legal disputes surrounding his status.
The government is pursuing another attempt at deportation while simultaneously advancing criminal charges against him.
