A federal judge is expected to make a decision by Thanksgiving regarding the request to dismiss criminal charges against former FBI Director James B. Comey and New York Attorney General Letitia James.

Attorneys for both Comey and James submitted a motion to U.S. District Judge Cameron McGowan Currie, asserting that prosecutor Lindsey Halligan’s appointment by the Trump administration was unlawful.

Comey faces allegations of lying to Congress and appeared in federal court in Alexandria, Virginia. His legal team contends that Halligan’s interim appointment as U.S. attorney for the Eastern District of Virginia violated legal limits, as her predecessor had already surpassed the 120-day maximum for temporary roles.

Comey’s lawyer, Ephraim McDowell, argued that Halligan lacked the authority to present a case against him before a grand jury. Similarly, James’ attorney Abbe Lowell claimed that Halligan acted outside her official capacity when she presented evidence in court.

The Justice Department defended Halligan’s prosecutorial authority during Thursday’s hearing. They also addressed concerns regarding former Attorney General Merrick Garland’s appointment of Special Counsel Jack Smith, who has indicted Trump in two separate cases.

A grand jury charged Comey on September 25 with making false statements related to media leaks and obstructing a congressional investigation into sensitive information disclosures. He pleaded not guilty in October.

James was indicted on October 9 for bank fraud and making false statements to secure favorable mortgage terms. In her motion to dismiss, she described the charges as retaliatory, citing derogatory remarks made by Trump about her character.

Both Comey and James have suggested that their legal challenges stem from personal vendettas linked to their past interactions with Trump. Comey’s lawyers argue that he is being targeted due to his protected speech and Trump’s animosity towards him.

The former FBI director played a significant role in initiating controversial investigations during Trump’s 2016 campaign, which some believe undermined Trump’s presidency. Additionally, he has been accused of leaking information regarding unverified claims made in the Steele Dossier against Trump.
