Investigation Overview
A recent investigation has determined that a Massachusetts judge, accused of assisting an illegal immigrant in evading arrest by Immigration and Customs Enforcement (ICE), was unaware of any escape plan. The findings indicate that the judge inadvertently facilitated the situation.
Judge Shelley Richmond Joseph permitted the illegal immigrant to return to a lock-up area in her courthouse, where the individual’s attorney collaborated with a court officer to facilitate an exit from the building.
The investigation, led by Hearing Officer Denis J. McInerney, concluded that Judge Joseph was not informed about any plans for escape and allowed the return to lock-up under the impression that a private consultation with his lawyer was necessary.
McInerney dismissed claims made by an interpreter and another lawyer present during the incident, labeling their testimonies as not credible. Instead, he supported Judge Joseph’s account and that of another attorney who confirmed she had no knowledge of any escape intentions.
Despite clearing Judge Joseph of wrongdoing regarding obstruction, McInerney suggested she receive a public reprimand for conducting an off-the-record sidebar conference, which contributed to public speculation about her involvement in aiding the migrant’s escape.
“I find that Judge Joseph did not know about — much less authorize — the escape plan and did not mislead court authorities following the incident,” McInerney stated. “However, I find that she inadvertently created the appearance of impropriety and bias.”
This case dates back to 2018 but has gained renewed attention following similar allegations against another judge in Wisconsin earlier this year. Milwaukee County Judge Hannah Dugan faces charges for allegedly obstructing ICE efforts related to a deportation target near her courtroom.
Judge Shelley Richmond Joseph serves as an associate justice in the Boston Municipal Court. The state Commission on Judicial Conduct has charged her with impropriety concerning this incident.
