As judges push for improved conditions at U.S. Immigration and Customs Enforcement (ICE) facilities, the agency is resisting calls to provide toothbrushes, citing safety concerns. ICE argues that these items could potentially be used as weapons.

The government informed a judge overseeing conditions at a facility near Chicago, stating, “Due to health and safety concerns, it is not advisable to provide everyone with a toothbrush as they can be used as weapons or to destroy property. However, to comply with the court’s order, toothbrushes and toothpaste have been added to the list of items that detainees can request and receive free of charge.”

This dispute over dental hygiene reflects larger issues surrounding migrant detention practices and the role of ICE itself. The agency has faced significant criticism from various groups, including Democrats who have drawn comparisons between its actions and historical atrocities.

The Broadview facility in Chicago has become a focal point for these discussions. It processes migrants apprehended during Homeland Security’s Operation Midway Blitz before either releasing them or transferring them to longer-term detention centers.

Migrants who have passed through Broadview report being denied access to legal counsel and enduring overcrowded conditions without basic necessities such as mattresses or adequate sanitation facilities.

Fredy Cazarez Gonzalez shared his experience in a written declaration, describing five days spent in unsanitary conditions where he felt pressured by officers regarding deportation paperwork. He stated, “The officers treated all of us like savage animals.” Other detainees reported instances of violence when they requested more food or questioned their treatment.

Homeland Security maintains that it provides adequate living conditions within the facility. Each cell reportedly includes a window and toilet facilities, along with access to phones and pro bono legal resources. However, detainees face challenges such as limited sleeping arrangements and inadequate bedding materials due to health concerns.

While ICE’s long-term detention standards include provisions for toothbrushes, the agency has resisted implementing this in short-term processing facilities like Broadview. In New York City, another facility facing similar scrutiny opted for dental wipes instead of toothbrushes amid ongoing legal battles over living conditions.

A recent court ruling mandated that ICE explore safer alternatives for toothbrush distribution. Options being considered include specially designed brushes that minimize security risks while still allowing detainees access to necessary hygiene products.
